01. Cancelling or changing an engagement

Send your request to business@avenelyssoftware.tech with your name or company, proposal reference and service concerned. AVENELYS acknowledges receipt and explains the effect on timing, work and deliverables. The arrangements below distinguish statutory withdrawal from other cancellations.

02. Consumer withdrawal

An individual acting as a consumer normally has 14 days to withdraw from a service contract concluded remotely or off premises without giving a reason. The period is calculated from conclusion of the contract, excluding the day of conclusion. If it ends on a Saturday, Sunday, public holiday or non-working day, it extends to the next working day. Statutory exceptions are explained before commitment.

To exercise this right, send a clear withdrawal statement before the deadline by email to business@avenelyssoftware.tech or by post to AVENELYS, Rue Victor Fort, 69004 Lyon, France. You may also use the standard form supplied with the contract. Valid withdrawal does not require acceptance by AVENELYS; keep evidence of sending it.

03. Starting within the withdrawal period

Work within the withdrawal period starts only after your express request is recorded on a durable medium with the required information. If you then withdraw, only the amount lawfully due for services actually supplied up to your statement may be charged, proportionate to the agreed price. No amount is due where the statutory conditions for such a request have not been met.

Withdrawal rights for a paid service fully performed before the period ends are lost only when statutory conditions are met, including your prior express agreement and acknowledgement that the right will be lost once performance is complete. A bespoke project does not automatically remove this right.

04. Information for your statement

You may state: “To AVENELYS — business@avenelyssoftware.tech. I wish to exercise my withdrawal right for the following service: [service and reference]. Contract concluded on: [date]. Name: [name]. Address: [address]. Statement date: [date].” Add a signature if sending it on paper. These details help identify the contract; any other unambiguous statement remains acceptable.

05. Cancellation before work starts

Outside statutory withdrawal, if no work has started and no authorised non-recoverable external cost has been incurred, payments received for unperformed work are refunded. Any retained costs must reflect actual, evidenced and previously accepted commitments, within the limits of applicable law.

06. Cancellation after work starts

Outside statutory withdrawal, work actually completed and authorised non-recoverable external commitments are assessed against the proposal and an evidenced statement. Any deposit balance relating to unperformed work is returned. A deposit is not automatically forfeited because of cancellation. Mandatory consumer rules prevail.

07. Pause or postponement

A postponement may be agreed in writing depending on progress and availability. Dates, restored access, any costs and project-material retention are specified. An extended pause may require a new schedule and updated proposal.

08. Refund arrangements

For statutory withdrawal, refundable sums are returned no later than 14 days after notification of your decision, subject only to amounts lawfully due for an expressly requested early start. The same payment method is used unless you expressly agree to another method without fees. Refunds do not depend on discretionary acceptance of withdrawal.

For other cancellations, an agreed refund is normally made within 14 days after the settlement statement is agreed in writing and necessary details are received, without overriding a more favourable mandatory deadline. A credit note or corrected document is issued where needed.

09. Business-to-business services

B2B work follows the proposal and contractual cancellation rules. No general 14-day withdrawal right is promised to every business client. Mandatory rights that apply to particular situations remain preserved.

10. Cancellation by AVENELYS

If AVENELYS cannot continue for a reason attributable to it, the parties arrange handover of useful work and refund of payments for unperformed work, without affecting other applicable rights. Force majeure is handled under the contract and applicable law.
